Booking Conditions

GENERAL OVERVIEW

All in Africa Safaris limited company is a registered tourism company based in Uganda and offering safaris to East African countries that include Uganda, Kenya, Rwanda, Tanzania, and the democratic republic of Congo, and other neighboring countries, the safaris are organized by this company that is registered with the government of Uganda. You are advised to read the terms and conditions and travel-related information as they set out the respective obligations and form the basis of your contract with us. In these terms and conditions, you meet all persons recognized or named on the booking including that one added later or substituted at a later stage. These provided terms and conditions can be amended at any time due to times and conditions. The terms and the time of booking are terms that are valid, remember that the circumstances within the same are those happening in the developed countries and the standards of the service, medical facilities, safety, and security as they may be lower than in those in your home countries. You need to recognize that the laws and regulations of the country in which services are provided apply to your holiday arrangements and not to your home country.

AUTHENTICITY OF INFORMATION

The descriptions, information, and opinions given by us in respect of national parks, animal sightings, accommodation, itineraries, gorilla permits, and security are given in good faith, based on the latest information available to us. Every care has been taken to ensure the accuracy of the information provided. We cannot accept any responsibility or liability for any errors or omissions caused by matters beyond our control.

CANCELLATION BY ALL IN AFRICAN SAFARIS

Sometimes we may cancel the confirmed bookings for reasons beyond our control, therefore we shall endeavor to cancel, but this happens when we reserve the right to do so. We shall not cancel your confirmed holiday booking less than 60 days before departure unless if you fail to make all the full payments and on time or we may be forced to cancel as the result of unusual or unavoidable reasons beyond our control.
The consequences of which we couldn’t avoid or control even with all the due care. Provide we cancel your safari holiday, we shall always provide you an alternative date when you can actually purchase your safari from us on the same booking standards and procedures that originally booked provided they are available. In case the chosen holiday or the alternative is cheaper compared to your original holiday, then as the company, we shall refund the difference and if it is expensive then, you will pay the difference. Alternatively, you are free to have the full refund if the funds that you have paid to us say for the gorilla permits only when the refund has been availed to us. Except where we cancel your holiday for reasons other than those mentioned in this clause, we shall have no further liability to you.
We regret that we cannot pay any expenses, costs, or losses you incur as the result of any cancellation. If we cancel for any reason that has not been mentioned here, then we shall pay you a maximum of one hundred and fifty United States dollars $150 based on the circumstances. All in Africa safaris reserve all the rights to, without any prior notice to terminate the holiday of any person or traveler or tourist in your party if, in your opinion or in the opinion of any person with the authority, the person concerned behaves in such way that is likely to cause danger or is a threat to the or may cause distress or annoyance to any third party or the damage to the property. In such a situation, the person(s) concerned will be able to leave immediately any facility /accommodation /service and no funds will be made and we shall not be able to pay any expenses or costs incurred because of this termination.

VOLUNTARY CANCELLATION

Should you or any member of the party be forced to cancel, you will need to notify or advise in writing. We shall not affect the cancellation until we receive your official written copy. To determine our loss as the result of your cancellation since we might not be able to resell your package holiday to another party, cancellation fees, excluding the insurance will be levied. The period before that departure and the voluntary cancellation fees (as the percentage of the total tour package where applicable)

VOLUNTARY EXECUTION

I acknowledge that I have voluntarily applied to engage and participate in the trip that is organized and attached to this application form participate ( or a trip which I may amend ) by advancing my deposit to the accounts of the All in African safaris and that I have read the description of the trip as it appears and that I have read the terms and conditions especially the cancellation policies and refund policies, responsibilities and the limitations of the liability especially on the advance payment of the to this safari company, the depositor, his or her family and beneficially

COMPLAINTS

In case you have a problem with your safari holiday, you must report immediately to your representative or the supplier of the product(s) in question who will work around the clock to resolve the issue. In case the problem has not been resolved to your satisfaction, you will need to write a report that you will need to address it to the safari manager in Kampala not later than 15 days after finishing your safari holiday to enable thorough investigation. We regret that reliability for any complaints not notified in accordance with this procedure cannot be accepted. If you fail to take any actions, you will hinder the ability of the company to put any problem right and/or investigate it fully and any right you have to receive compensation will be reduced or completely invalidated.
All relevant information that is provided by the company whether in writing or orally is to the best of the all-in African safaris knowledge and it is believed correct at given and in good faith. The booking conditions shall take superiority over any other warranty or condition that may have been agreed upon.

FORCE MAJEURE

We regret that we cannot accept the liability to pay or compensate where the performance or good performance of our obligations that is affected by any event which we or the supplier of the services or products in question couldn’t, even with all due care, foresee or avoid. Such circumstances include the threat of war, riots, border closure, terrorist activity, unexpected government acts, nuclear disaster, extreme weather conditions, mechanical problems to transport, road closures, disease, and all similar events beyond our control

GORILLA PERMITS

The moment the payment is made, and the gorilla tracking permits are purchased to the respective national park, It is not guaranteed that you will see the gorilla once you have paid the gorilla permit. However, the chances of seeing the gorillas are as high as 99%. Sometimes the local conditional available may make you see the gorillas on short notice. All in Africa safaris is not reliable of any conditions that might lead to gorilla seeing canceled, maybe it is the closure of the national park or the boundaries, absence of the booked gorillas, or security changes. Refunds are at the discretion of the authorized authority and we do not accept liability from them. However, we shall use all our necessary means to make sure that we obtain refunds and if the authorized authority avail us of the refund, we shall pass it on to the client.

QUOTATIONS

Please ensure that the quotation given with the details of a number of client’s dates, accommodation, transportation, permits, park entrance fees, and other services provided is very clear and curate before agreeing or confirming with the booking in writing. All references to quotations in writing shall include reference to correspondence by exact copy and electronic mail. The price of your safari holiday will be confirmed at the time of booking, and the company reserves all the right to correct errors in both advertised and confirmed prices as soon as possible.
After the price of your safari holiday has been confirmed, subject to the correction of errors, a surcharge will only be payable if transportation costs, taxes, accommodation costs, or gorilla permits increase in total to over 2% (two percent) of the holiday price. If you are required to pay more than 10% (ten percent) of the original holiday price, you will be permitted to cancel your safari holiday with a full refund of all the money paid to us except fees paid for gorilla permits. Should the traveler decide to cancel under these provisions, a right to do so must be exercised within 14 (fourteen) days of notification to you of the surcharge. We reserve the right to increase or decrease the prices of unsold holidays at any time.

PASSPORTS, VISAS, AND TRAVEL DOCUMENTS

Visitors traveling with All in African Safaris shall make sure that they have proper records that include the VISAS, Passports, or proper identification cards. Passport must be valid for at least 5 months before your departure date. Please note that some of the destination countries require a full blank page in the passport for stamping purposes.

PAYMENTS

Once you have booked your safari, you must commit yourself and confirm that you totally agree with the terms and conditions of the safari and you will need to pay the commitment fee (deposit) of a certain percentage which will be determined by your safari consultant usually it includes the 30% and the full price of the gorilla permits but you may be required to pay more depending on the availing circumstances related to the season of the booking. You may be asked to pay 40% as the commitment fee when you book during the peak season when all bookings are made in advance especially the primate permits and the lodges. The remaining balance must be paid before the actual date of your safari in order to make it possible to enough arrangements in terms of booking.

INSURANCE

It is important that and we take it as the requirement that any person or party booking with a safari shall arrange the personal travel insurance that is effective and valid. In case their visitors are not perfect for the long trips especially those with heart attack disease, advanced pregnancy, and those with mental illness are not supposed to engage in such strenuous activities unless advance information is given for their preparation. The particulars of the insurance should include injury, death, medical expenses, and theft of personal property. For visitors interested in high adventure activities such as mountaineering, bungee jumping, and whitewater rafting, the insurance should as well cover these risk activities.

GOVERNING LAW AND JURISDICTION

All in Africa safaris is incorporated with the Republic of Uganda and it operates under the laws of Uganda. Matters arising out from your contact with us will be governed by the laws of Uganda.

LIABILITY

We shall make every reasonable effort to ensure that all component parts of the safari holiday are supplied as described in the brochure/itinerary and to a reasonable standard, and our employees, suppliers, agents, and sub-contractors implement outstanding care in carrying out our obligations under the contract. We accept responsibility for what our employees, suppliers, agents, and sub-contractors do or do not do (provided they were at the time carrying out work authorized by us).
If any part of your safari holiday is not provided as advertised/prescribed and to a reasonable standard, we shall compensate appropriately if your enjoyment of the safari/holiday has been affected and you have followed the complaints procedure set. This acceptance of responsibility is subject to the clause relating to “Force Majeure” and generally Terms and Conditions. Our maximum liability in respect of complaints (except where death, personal injury, or illness results, or where claims relating to damage or loss to luggage ) is limited to an amount equal to the cost paid by or paid on behalf of the person affected for the applicable services.
The maximum amount will be payable only where the person affected has no benefit from the holiday and none of the services contracted have been provided. Liability for damage or loss to luggage or personal belongings (including money) will be compensated to a maximum of USD 30 on the basis that the client is assumed to have taken acquired an insurance cover in respect of such losses at the time of booking.

WHAT IS INCLUDED WITH THE SAFARI PACKAGE

The prices shall INCLUDE the accommodation facilities, the company of an English speaking guide, the park entrance fees, airport transfers, safari vehicle, all ground transportation, gorilla and chimpanzee trekking permit, where appropriate, airport transfers, porterage of two items of baggage per person, boat trips or safaris and meals as stated.
The price shall EXCLUDE airfare to Uganda or Rwanda, entry visas fees to Uganda or any other destination we do organize, gratitude and the airport taxes, and all the personal related expenses such as the drinks at the lodge and the laundry services, in Kampala. Entebbe or Kigali Rwanda, the safari includes the bed and breakfast only. On the safaris, the prices cover the same board. We reserve the right to change the safari services agreed with the clients in the event of unseen situations such as bad weather, problems with the national parks or at the hotel, as well as the security considerations. Alternative arrangements will be made in case of such scenarios.

TRANSPORTATION

We ensure that our vehicles provided are in worthy road conditions but not reliable for any breakdown, or delay or any damage, our safari guide is instructed to follow the code of conduct of the guides that are available. In the event that a Guide does not follow the code of conduct, please inform the Safari Manager in Kampala. Company vehicles must be driven only by the company’s Guide who decides on all matters, such as routes taken is final. The client will be liable for any damages to the vehicle caused by any interference by them, including legal costs

DANGERS POSED BY WILD ANIMALS

You’re advised that while the wild or in the national park, you need to recognize that the animals are wild and therefore can pose any threat to your life or safety. Thus you’re observed to respect and observe the rules and regulations of the local park and follow all the instructions that are given to you by the safari guide

KEY INFORMATION

The tourist costs are all based on the exchange rates at the transfer and any changes that happen will be made and communicated to you immediately. We also reserve the right to change any arrangements due to the local conditions, the right to refuse any person from participating or continuing any tour for cases such as; that person causes or is deemed to cause the hazard or inconveniences to other clients, and to the environment and the ecosystem. Please note that in Uganda US dollar banknotes series are accepted only with a low exchange rate. Commercial banks and upcountry towns don’t accept the above transactions. In most cases, such transactions are only done by forex bureaus within Kampala therefore you are advised to travel to Uganda with more recent banknotes series.
